Terms & Conditions

Effective date: January 1, 2025

1. Acceptance

By accessing or using Polletra, you agree to these Terms. If you are using Polletra on behalf of a company, you represent that you have authority to bind that company.

2. Description of Service

Polletra provides a feedback collection and management platform accessible via web dashboard, embeddable widget, and REST API. Features vary by plan.

3. Accounts

You must provide accurate registration information. You are responsible for all activity under your account. You must notify us immediately of unauthorized use. We may suspend accounts for violations of these Terms.

4. Acceptable Use

You may not use Polletra to:

  • • Collect data from children under 16 without parental consent.

  • • Send spam or unsolicited communications.

  • • Reverse-engineer the platform.

  • • Circumvent rate limits or security controls.

  • • Upload malicious code.

  • • Violate any applicable law.

5. Tenant Responsibilities

Tenants are responsible for:

  • • Obtaining lawful basis to collect End User data.

  • • Providing End Users with a privacy notice disclosing use of Polletra.

  • • Ensuring End User data submitted to Polletra complies with applicable data protection law.

  • • Keeping API keys secure and rotating them if compromised.

6. API and Widget Usage

API keys are scoped per environment. Origin allowlisting is the Tenant's responsibility to configure correctly. Polletra enforces rate limits per plan. Excessive use beyond plan limits may result in throttling or suspension.

7. Fees and Payment

Fees are charged per the plan selected at signup. Free plans have no fee. Paid plans are billed monthly or annually in advance. Overages (tracked user limits) are billed at the end of the billing cycle. All fees are non-refundable except as required by law. We use Stripe for payment processing.

8. Free Trials

14-day free trials are available on Core and Pro plans. No credit card is required to start. At the end of the trial, the account reverts to Free unless a payment method is added.

9. Intellectual Property

Polletra retains all rights to the platform, codebase, and brand. Tenants retain all rights to their own data and content submitted through the platform. Tenants grant Polletra a limited license to process their data solely to provide the service.

10. Confidentiality

Each party agrees to keep the other's non-public information confidential and not to disclose it to third parties without consent, except as required by law.

11. Disclaimer of Warranties

The service is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose or uninterrupted availability.

12. Limitation of Liability

To the maximum extent permitted by law, Polletra's total liability for any claim arising out of or relating to these Terms shall not exceed the fees paid by the Tenant in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

13. Indemnification

Tenants agree to indemnify and hold harmless Polletra from claims arising from: their use of the service, their End Users' data, or their violation of these Terms.

14. Termination

Either party may terminate at any time. Tenants can delete their account from the dashboard. We may terminate immediately for material breach. On termination, Tenant data is available for export for 30 days, then deleted.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law provisions. Disputes shall be resolved in the courts of Delaware.

16. Changes

We may update these Terms with 30 days' notice via email for material changes. Continued use after the effective date constitutes acceptance.
